Last August, I was involved in a pretty horrific accident. A woman ran over myself and 4 of my friends, killing one of them. We were all pedestrians. I had to wait until the trial was over and she was sentenced (guilty of 2nd degree manslaughter + 4 counts of 3rd degree assault). Trial finally ended about two months ago, and my lawsuit began last month.
With this being such a seemingly cut and dry lawsuit, I was wondering on average they take to settle. My lawyers are suing her insurance company (AllState).
I’m hoping that the lawsuit will end fairly soon — despite having no-fault insurance claims, I’ve been stuck paying most of the medical bills because AllState isn’t; and it’s causing me to go bankrupt.

Lawsuits are not fast things.
Since you have hired an attorney and will be paying him 1/3 of any settlement you get…I suggest you follow up with him. He knows the venue and the facts of your case. He is the best one to give you an estimate of how long this could take.

Depends on a lot of things, but usually it doesn’t "settle" until right before the court date, or the statute of limitations runs out.
The problem with your case, is that the insurance company won’t EVER pay more than the policy limit. You are NOT suing her insurer – you’d lose. You have to sue HER. And if you get a judgement for way lot more than her insurance policy has coverage, your LAWYER is going to end up with all the money, and all you’ll have in the end, is a judgement against her.
