Loading ...The defendants lawyers are trying to say that the defendants weren’t properly served. The sheriff served them. Anyhow, if the lawyers are using this as one of the affirmative defenses, to protect the case before a ruling is made, should I file this case in federal court as well, because there are 2 federal questions present, and the jurisdictional amount present.

No. You need to determine the proper venue. Based on your other questions, you need a lawyer. Two federal questions? Get a lawyer.

You can’t file the same case in federal court and state court at the same time. Pick one. If you want to go to federal court, dismiss the state case and file your federal one.
