The attorney generals office has told me to get an attorney because my ex is making more the maximum monthly amount they deal with (00). It has been 4 1/2 years since the initial child support amount was established and my ex’s salary has more than doubled. I am a teacher and can not afford an attorney. Any suggestions on how to get started?

some attorneys will work something out w/ you like taking a monthly payment instead of lump sum when the attorney gets your child support up by then you should be able to afford a monthly payment to an attorney for a while

I live in Ohio and here you can have it done through child support. I am not sure if it is every two years or three but it is one of them. One party calls and requests it and they have everyone send in their financial papers, W-2′s, paycheck stubs and all of that and they decide if it is raised, lowered or stays the same. Call your child support bureau and ask or look at their site on line.

Its actually pretty easy. You don’t really need a lawyer.
Go to the family probate department in your local courthouse. Ask for ‘modification’ papers. Fill it out (with your reason being his income increase). Give it back to the person at the counter.
In a few weeks you’ll get a court date in the mail that both you and your ex need to attend. He will have to show his pay stubs. They take a percentage (usually 20%) for child support. As long as it has significantly increased, you will get more CS.
*You have a right to have your child support judgment reviewed every three years, even for NO REASON!

You don’t need an Attorney. Just fill out the paperwork. All they need are figures. Child support is figured by an equation, the amount he makes, the amount you make, the percentage of time both of you spend with the child(ren), expenses, sometimes other children from other relationships are taken into consideration depending on the state you live in. They throw it all in a magic hat and shake it up and wallah. Child support. The only reason you would need a lawyer is if you think he would be able to hide his income or hire a lawyer that will get him out of paying. Most judges are pretty smart and can see through their games. If you happen to have a paper trail of his income,witnesses or any other proof. hold onto it.

I agree with the person who said it is pretty easy to just file a modification, and it is, but it does cost about $100. In Georgia I know you can do it through child support services if you have a court order over 3 years old. Try calling them for some advice.
